Ce 2 juin 2026, Pierre-Yves Thoumsin prendra part au colloque organisé par la Conférence du jeune barreau de Bruxelles et intitulé “Code civil et droits supplétifs: quelques enjeux pour les marchés publics”.
Sa contribution portera sur les droits intellectuels et les marchés publics, sous l’intitulé “faut-il préférer le sur-mesure au prêt-à-porter“.
Les actes de ce colloque seront publiés chez Anthémis.

Les droits intellectuels en 2026: défis et opportunités
Notre associé Pierre-Yves Thoumsin a coordonné, avec Frédéric Lejeune, l’ouvrage « Les droits intellectuels en 2026 : défis et opportunités » publié chez Anthémis.
Cet ouvrage sera présenté lors d’une conférence de lancement organisée le 11 mars 2026, à Bruxelles. Les inscriptions sont ouvertes sur le site de l’éditeur.
Au sein de cet ouvrage, Pierre-Yves Thoumsin et Justine Avaux proposent une contribution consacrée aux « 10 commandements du marketing vert ». Ils y abordent la manière dont le « greenwashing » ou « écoblanchiment » est encadré par le droit des marques, le droit de la concurrence déloyale et l’autorégulation.

Félicitations à Louis Peigneux !
Le 16 janvier 2026, à l’occasion de la séance solennelle de rentrée du barreau de Bruxelles, Louis Peigneux s’est vu décerner l'un des deux prix des bâtonniers Braun et Jakhian pour l'année 2025.
Ces prix sont décernés aux deux avocats stagiaires ayant obtenu la meilleure note d’ensemble aux examens CAPA, lors de l'année écoulée.
Bravo Louis pour ce beau résultat et cette récompense méritée !
Individual, collective and certification marks: what’s the difference ?
One of the most notable aspects of the trademark reform was the introduction of a new type of trade mark at the European level: the certification mark.
The certification mark now provides an additional, specific type of protection, alongside the existing individual and collective marks.
The importance of this choice was emphasised in the « Cotton Flower » judgment of the Court of justice of the European Union.
In that case, a cotton flower logo was registered as an individual trademark but was actually used as a quality label for cotton goods.
The Court emphasised that using an individual trade mark as a label does not amount to genuine use of that mark if the goods are not produced under the control of the owner of the mark.
This finding has a radical consequence, because an individual mark that is used as a label can be revoked for lack of genuine use, for example as a counterclaim in infringement proceedings.
This judgment clearly highlights the importance of selecting the certification mark when the mark is meant to serve as a quality label.
